OVERVIEW
This website is operated by Casual Cacti LLC (“XMilesOut”, “we”, “us”, or “our”). By visiting or purchasing from our site (the “Site”) at www.xmilesout.com, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any additional terms and policies referenced herein and/or available by hyperlink on the Site.

These Terms apply to all users of the Site, including without limitation browsers, customers, merchants, and contributors of content. Please read these Terms carefully before accessing or using the Site. If you do not agree to all the Terms, you may not access the Site or use any Services.

Our store is hosted on Shopify Inc. Shopify provides the online e-commerce platform that allows us to sell our products and services to you.

SECTION 1 — ELIGIBILITY AND ONLINE STORE TERMS
By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence (or that you are the age of majority and you have given us your consent to allow any of your minor dependents to use the Site).

You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including, without limitation, intellectual property laws).

SECTION 2 — GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time, to the extent permitted by law.

You understand that your content (excluding payment information) may be transferred unencrypted and may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Payment information is handled by our payment processors and is transmitted using security measures consistent with industry standards.

SECTION 3 — ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We are not responsible if information made available on this Site is not accurate, complete, or current. The material on this Site is provided for general information only and should not be relied upon as the sole basis for making decisions without consulting more accurate, complete, or timely sources.

SECTION 4 — MODIFICATIONS TO THE SERVICE AND PRICES
Prices for our products are subject to change without notice.

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice, to the extent permitted by law. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service, except as required by applicable law.

SECTION 5 — PRODUCTS AND PRINT-ON-DEMAND DISCLOSURE
5.1 Print-on-demand / made-to-order
Many XMilesOut products are produced using print-on-demand (“POD”). This means products are generally made after you place an order. As a result:
- Production may begin shortly after purchase, which can limit cancellations and changes (see Section 8).
- Minor variations in print placement, color, and texture can occur due to POD processes and normal manufacturing tolerances.
- Product colors may appear differently on different screens.

5.2 Product descriptions and availability
We attempt to display product descriptions, images, and sizing information as accurately as possible. However, we do not warrant that product descriptions, colors, or other content are accurate, complete, reliable, current, or error-free.

We reserve the right to discontinue any product at any time. We may limit the quantities of any products that we offer.

SECTION 6 — ORDERS, BILLING, AND ACCOUNT INFORMATION
6.1 Order acceptance
We reserve the right to refuse any order you place with us. We may, in our sole discretion and to the extent permitted by law, limit or cancel quantities purchased per person, per household, or per order. We may attempt to notify you if an order is changed or canceled using the email and/or billing address/phone number provided at the time the order was made.

6.2 Billing information
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store and to promptly update your information so we can complete your transactions and contact you as needed.

SECTION 7 — SALES TAX
Sales tax may be collected on taxable orders as required by applicable law and may vary based on the shipping destination and other factors. Taxes (if applicable) will be displayed at checkout.

SECTION 8 — CHANGES, CANCELLATIONS, AND ADDRESS ERRORS (POD IMPORTANT)
Because POD items may enter production quickly, requests to cancel or modify an order (including size, color, design, or address) must be submitted as soon as possible. We cannot guarantee that changes or cancellations can be made after an order is placed.

If you provide an incorrect or incomplete shipping address and the carrier returns the package, you may be responsible for any reshipment costs.

SECTION 9 — SHIPPING, DELIVERY, AND RISK OF LOSS
Shipping and delivery dates are estimates and not guarantees. Delivery may be affected by production time, carrier delays, weather events, peak-season volume, customs (if applicable), and other factors outside our control.

To the extent permitted by law, risk of loss passes to you upon our tender of the products to the carrier. If your package is marked delivered but you cannot locate it, please contact the carrier first and then contact us for assistance.

SECTION 10 — RETURNS, REFUNDS, AND EXCHANGES
Your purchase is also governed by our Refund/Return Policy posted on the Site.

10.1 POD standard (no “buyer’s remorse” returns)
Because POD apparel is made-to-order, we generally do not accept returns or exchanges for:
- wrong size selection
- preference-based reasons (e.g., “changed my mind”)
- minor expected variations in print/color due to normal POD tolerances

Please use the sizing chart and product details before ordering.

10.2 Defects, damage, or wrong item
If your item arrives defective, damaged, misprinted, or you received the wrong item, contact us within 14 days of delivery at customerservice@casualcacti.com with:
- your order number
- clear photos showing the issue (and packaging if damaged)
- a brief description of the problem

If confirmed, we will provide a replacement or refund as appropriate. We may require the item to be returned in some cases or additional documentation to support a claim.

SECTION 11 — INTELLECTUAL PROPERTY
All content on the Site, including but not limited to trademarks, logos, designs, artwork, graphics, product mockups, and text, is owned by or licensed to XMilesOut and is protected by intellectual property laws. You may not use, reproduce, distribute, display, or create derivative works from our content without our prior written permission.

SECTION 12 — USER CONTENT (IF YOU SUBMIT CONTENT)
If you submit reviews, comments, images, or other content (“User Content”), you grant XMilesOut a non-exclusive, royalty-free, worldwide, perpetual (or to the maximum extent allowed by law) license to use, reproduce, publish, and display such User Content in connection with operating and marketing the Site and our products.

You represent that you own or have the necessary rights to submit User Content and that it does not violate any third-party rights or laws.

SECTION 13 — THIRD-PARTY SERVICES AND LINKS
Certain content, products, and services may be provided by third parties (including payment processors, analytics providers, and POD fulfillment partners). We are not responsible for third-party services, websites, or content, and your use of third-party services may be subject to their own terms and policies.

SECTION 14 — PROHIBITED USES
In addition to other prohibitions as set forth in these Terms, you are prohibited from using the Site or its content:
(a) for any unlawful purpose;
(b) to solicit others to perform or participate in unlawful acts;
(c) to violate any international, federal, state, or local laws or regulations;
(d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
(e) to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate;
(f) to submit false or misleading information;
(g) to upload or transmit viruses or any other type of malicious code;
(h) to interfere with or circumvent the security features of the Service or the Site.

We reserve the right to terminate your use of the Service for violating any prohibited uses, to the extent permitted by law.

SECTION 15 — DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Service and all products delivered to you through the Service are provided “AS IS” and “AS AVAILABLE” for your use, without any representation, warranties, or conditions of any kind, either express or implied, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

Some states do not allow limitations on implied warranties, so some or all of the above may not apply to you.

SECTION 16 — LIMITATION OF LIABILITY
To the fullest extent permitted by law, in no case shall XMilesOut, our owners, employees, contractors, agents, or suppliers be liable for any indirect, incidental, punitive, special, or consequential damages (including lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages) arising from your use of the Service or any products purchased using the Service.

To the fullest extent permitted by law, our total liability for any claim arising from or relating to the Service or products shall not exceed the amount paid by you for the product(s) giving rise to the claim.

Some states do not allow the exclusion or limitation of certain damages, so some or all of the above may not apply to you.

SECTION 17 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless XMilesOut and our owners, employees, contractors, agents, and suppliers from any claim or demand (including reasonable attorneys’ fees) made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

SECTION 18 — SEVERABILITY
If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 19 — TERMINATION
These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by ceasing to use our Site. We may terminate or suspend access to the Service at any time, without notice, if we believe you have failed to comply with any term or provision of these Terms, to the extent permitted by law.

SECTION 20 — ENTIRE AGREEMENT
These Terms and any policies posted by us on this Site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications, and proposals.

SECTION 21 — GOVERNING LAW
These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to conflict-of-law principles.
